NODAL AGENCY TO MONITOR E-ADVERTISEMENTS VIOLATING SECTION 22 OF PC & PNDT ACT, 1994

BACKGROUND: PC & PNDT Nodal Agency was established at the National Institute of Health and Family Welfare, under the Ministry of Health and Family Welfare in February 2017, as per directives of the Hon'ble Supreme Court of India in response to Writ Petition (Civil) No. 341/2008, as an interim arrangement, to monitor the e-advertisements related to pre-conception and pre-natal determination of sex or sex-selection, prohibited under Section 22 of the PC & PNDT Act, 1994.
FUNCTIONING OF NODAL AGENCY: The primary objective of the Nodal Agency is to regulate the e-advertisements and facilitate their removal. After due authentication of complaints with respect to the violation of section 22 of PC & PNDT Act, the complaints received from the general public/ government functionaries/ other sources are forwarded to the respective search engines/websites/social media platforms for appropriate action, e.g. Blocking URLs and follow-up is done on the action taken by them. Furthermore, the Nodal Agency also performs active/ suo-moto monitoring and monitors different search engines and social media platforms such as Google, Yahoo, Bing, YouTube, etc. for violation and takes necessary action against them.
